公众参与环境治理的权利保障研究
摘要
建设美丽中国离不开生态环境治理，生态环境治理事关中华民族的未来
和中国人民的福祉，是建设中国特色社会主义的重要内容。生态环境治理是
应对环境污染严重，自然资源趋紧和生态系统退化等严峻环境形势的关键一
招，是生态文明建设和实现中华民族永续发展的重要保障。生态文明建设时
代的到来促进了一些权利的发展，其中包含了公众参与环境治理权。公众参
与环境治理的权利是指公众为保护和实现环境利益，可以通过了解环境信息、
参与环境治理、进行环境治理监督的方式对环境治理、生态保护等问题，积
极将自身环境诉求表达于外且受法律保护、支持与限制的权利，包含了环境
知情权、环境表达权、环境监督权。研究公众参与环境治理权利机制不仅能
推进生态文明建设，还能促进社会的民主发展。探索公众参与环境治理权利
机制首先要从公众环境表达权的权利构造入手，分析公众参与环境治理的主
体、客体和内容的构成要素与防御、受益与救济的权能，在此基础上梳理我
国公众参与环境治理权利的实践情况，深入研究公众参与环境治理知情权、
表达权、监督权在实践中存在的问题与不足，针对环境治理知情权、表达权、
监督权的实践困境提出权利保障措施。
