建设工程优先受偿权转移的研究
摘要
为了保障建设行业弱势群体,我国立法赋予承包人对所建工程享
有优先受偿的权利。而在工程实践中,由于发包人支付工程价款时间
过长,导致承包人为了快速回笼资金而转让工程债权,此时优先受偿
权的效力如何,受让人能否同时取得优先受偿权,对此问题理论界未
形成统一的学术观点,司法中也未能形成统一的判决,长此以往,将
损害司法公正。为明确此法律问题的适用,为司法裁判统一观点提供
意见,实有必要对建设工程优先受偿权问题展开研究。建设工程优先
受偿权是法定优先权,具有担保物权的从属性,原则上可以随着建设
工程价款债权的让与而转移。同时,建设工程优先受偿权受到公平原
则的限制,其不能随意转移,是附条件进行转移的,其转移应当兼顾
维护建设行业弱势群体的利益。

ABSTRACT
Inordertoprotectthevulnerablegroupsintheconstructionindustry,
Chineselegislationgivesthecontractortherightofpreferential
compensationfortheconstructionproject.Intheengineeringpractice,
becausetheownerpaystheprojectpriceforalongtime,thecontractor
transferstheprojectcreditorsrightinordertoquicklyrecoverthefunds,
whatistheeffectoftherightofpreferentialcompensationatthistime,
andwhethertheassigneecanobtaintherightofpreferential
compensationatthesametime?Thetheoreticalcirclehasnotformeda
unifiedacademicviewonthisissue,andthejudicialsystemhasnot
formedaunifiedjudgment.Ifitgoesonlikethisinthelongrun,judicial
justicewillbedamaged.Inordertoclarifytheapplicationofthislegal
issueandprovideopinionsfortheunifiedviewofjudicialadjudication,it
isnecessarytocarryoutresearchonthepriorityofcompensationof
constructionprojects.Thepriorityofcompensationofconstructionproject
isthelegalpriority,whichhasthesubordinatepropertyofsecurityright.
Inprinciple,itcanbetransferredwiththeassignmentofthecreditors
rightofconstructionprojectprice.Atthesametime,thepriorityof
compensationofconstructionprojectsisrestrictedbytheprincipleof
equity.Itcannotbetransferredatwill,butistransferredwithconditions.
The
